Pennsylvania Supreme Court Will Determine Fate of Controversial Skill GamesPosted on: November 27, 2025, 05:52h.Last updated on: November 26, 2025, 02:52h.The Pennsylvania Supreme Court is reviewing the legality of skill games.The slot-like games include elements of skill, which impact payout rates.High Court Hears Arguments on Skill GamesLast week, the Pennsylvania Supreme Court heard the case for and against skill games, slot-like gaming devices that casino attorneys argue constitute illegal gambling.The state’s highest court will determine if the skill component of skill games renders the machines immune from the Pennsylvania Gaming Act.Proponents of the games developed by Georgia-based Pace-O-Matic and assembled locally by Miele Manufacturing, a company based in Lycoming County, say players can alter their win rates, and therefore the games are not fully dependent on luck as are casino slots.The Supreme Court is reviewing whether lower state courts got it right in determining that the Gaming Act and Pennsylvania Criminal Code do not apply to skill games. The machines have remained inside convenience stores and gas stations, grocery stores, corner markets, restaurants, and bars since a judge in Beaver County ruled in 2014 that the gaming apparatuses are not illegal.Definition of Gambling at the Center of the CaseThe Pennsylvania skill gaming appeal is brought by the state Attorney General’s Office and the Department of Revenue. Arguing the case on behalf of the state, Senior Deputy Attorney General Susan Affronti said the definition of gambling lends to skill games.Gambling is the hope of gaining something beyond the amount played,” Affronti declared before the justices. “What is this game really about? This isn’t a game of Whac-A-Mole or Skee-ball. This is a slot machine.”Skill games, commonly branded Pennsylvania Skill in the commonwealth, allow players to alter their payout rate by identifying winning paylines. A slot machine automatically does that.Skill games also allow players to recoup their losses through a memory challenge called “Follow Me.” The bonus round tasks the player with repeating an increasingly complicated series of colors not unlike the Hasbro classic electronic short-term memory game Simon.Skill game attorneys say a player, because of the Follow Me round, has the potential to achieve a payout rate of 105%. Attorney Matthew Haverstick, representing Capital Vending Company, which was charged in a 2019 state police raid for providing skill games to a Dauphin County business, said the Pennsylvania Gaming Control Board requires casino slots to be programmed to pay out above 85%. Since slots cannot be programmed to pay out above 100%, a skill game “can never be a slot machine as defined under the Gaming Act statute.”Haverstick added that since skill game players can win every time, should they endure the Follow Me option, he contends that skill games cannot be lumped in with slots.The Pennsylvania Supreme Court is expected to render its opinion on skill games in the coming months.Push for Regulation and TaxationThe skill game industry is calling on state lawmakers in Harrisburg to regulate and tax its games. Proponents claim a reasonable tax rate, one much lower than the casino slot tax of 55%, is needed to allow the machines to continue benefiting small businesses.Pennsylvania Gov. Josh Shapiro (D) wants to legalize skill games to generate new tax revenue. He’s called on the General Assembly to send him a skill game bill with a 52% state take.Other bills have suggested lower state taxes, with one measure seeking only a 16% state tax.

In the case of Ohio, another state with regulated gaming, the share of the legal market is just 15% of the $6.2 billion market total, with around 917 operators detected locally.Crypto is another issue for staying on top of regulated gambling, with Yield Sec arguing that it has identified tens of thousands of crypto casinos all over the world, and each, the firm argues, is finding a way to exploit some regulatory loophole.Using Counter-Terrorism Methodology, But Are the Numbers Right?Yield Sec is confident about its ability to track data from the unregulated and illegal gambling sectors and markets.Yield Sec is the only firm actively monitoring illegal gambling activity in real time. Other firms often rely on estimates, legal filings, or indirect data sources, which don’t capture the true scale of illegal activity – particularly outside of regulated channels.Vali explains that the methodology used by his firm was originally used and deployed to respond to terrorist threats, such as ISIS, but has evolved to track gambling volumes for events such as the Super Bowl and March Madness with remarkable accuracy.Despite the claims laid bare by Yield Sec, one issue persists – how is it possible for the firm to paint a picture so grim when it comes to illegal gambling, when mainstream and specialist research firms are failing to quite produce the same numbers?

And he did.“Kalshi relies on a strained reading of the already convoluted Commodities Exchange Act (CEA) in an attempt to evade state regulation,” Gordon wrote in Monday’s decision. “Kalshi’s interpretation would require all sports betting across the country to come within the jurisdiction of the CFTC rather than the states and Indian tribes. That interpretation upsets decades of federalism regarding gaming regulation, is contrary to Congress’ intent behind the CEA, and cannot be sustained.”Gordon’s decision to dissolve Kalshi’s preliminary injunction quickly led to further litigation, as the prediction market operator seeks to protect its legal standing to facilitate wagering across the U.S. on a variety of events, including sporting ones.Kalshi’s Response and Appeal PlansKalshi filed for a stay of the dissolution order on Tuesday, claiming that it "faces a threat of imminent criminal enforcement by Nevada authorities."The prediction market operator added that it intends to file a notice of appeal."Defendants have left little doubt that they would bring criminal charges against Kalshi absent a stay," Kalshi's legal filing said. "But even if Kalshi could avoid prosecution by taking expeditious steps to geofence, Kalshi would face severe irreparable harm from shuttering existing contracts for users in Nevada."Prediction Markets Under Scrutiny NationwideSimilar lawsuits and regulatory actions are raging all over the U.S. at the moment, as prediction markets and state gambling regulators scrap over the legality of sports event contracts.Those contracts can be bought and sold by the users of federally regulated prediction markets, allowing them to make de facto bets on sporting events, politics, and economics, among other things.However, it is mostly the election and sports-related contracts that have irked state gaming regulators, as they see gambling as their bailiwick, not the CFTC.Sports Betting or Prediction Market?“Kalshi has established a market for sports betting,” Judge Gordon wrote. “Kalshi advertised that it is the ‘first app for legal sports betting in all 50 states.’ But Kalshi is not licensed to conduct gaming in Nevada or any other state.”Kalshi is now seeking to pause Gordon's latest decision. Otherwise, the prediction market could have to shut down its contested offerings in the state, as Crypto.com did.Serious Legal Questions RemainThere may be some grounds (or “serious questions”) for Kalshi to obtain some relief in the interim.“I dissolve the injunction because the (Nevada Gaming Control Board) has shown that Kalshi is not likely to succeed on the merits, although there are serious questions on the merits,” Gordon wrote. “The Board also has shown that the balance of hardships does not tip sharply in Kalshi’s favor. Rather, the balance of hardships tips in favor of the Board, and the public interest favors dissolving the injunction.”
