Existing Michigan laws on gambling

Because America is a Federation of 50 states, the federal government does not make laws to cover specific fields, leaving state legislators to enact laws for state operations. Casino gaming operations in Michigan are governed by the Michigan Gaming Control & Revenue Act 1996 - besides the gambling games available, other operations like the gambling age in MI are decided by the Act, amongst others. The gambling age applies to both residents and visitors. For example, the legal gambling age for lotteries and horse racing is 18. Other online casino activities in Michigan that involve alcohol, in contrast, require a legal age of 21. Michigan actually isn’t all that different from other legal and regulated gambling states, such as New Jersey, Pennsylvania, and Delaware.

But since the 2020 passage of legislation authorizing online casinos, the Michigan Gaming Control Board (MGCB) has been in charge of licensing both land-based and virtual casinos in MI. MGCB has the authority to regulate the activities of registered Casinos through licensing. MGCB was also established to shoulder the responsibility of enforcing Michigan's gambling stipulated rules. The Michigan Gaming Control Board levies a 20-28% tax on virtual casinos, an 8.4% tax on sports betting and DFS sports, and an 11.4% tax on land casino revenue. MGCB also levies a 4.25% tax on player winnings, and if your winnings are over a certain amount, the casino site will file a tax form (the W-2G form) on your behalf

 

Possible changes in gambling regulation

In Michigan, there has been a high increase in unlawful casino dealings, and this was confirmed by the reports of the AGA (American Gambling Association) of a sum of $511 million in unregulated casino dealings. As a result of this, the MGCB may undoubtedly tighten its laws. The Michigan Gaming Control Board expresses the urgent need for residents to stop illegal gambling, particularly the use of illegal gambling machines, as of December 2022.
